California Overtime Pay Regulations
To prevent employers from taking advantage of their workers, as well as to prevent unnecessary lawsuits from employees who claim to be overworked, the California Department of Industrial Relations requires that hourly employees be paid extra overtime hours. “Overtime” means any of the following:
- Any hours worked exceeding eight hours in any workday
- Any hours worked exceeding 40 hours in any workweek
- Any hours worked on a seventh consecutive day in any workweek
- The rate of pay for overtime hours is as follows:
• One and one-half times the employee’s regular rate of pay for all hours worked in excess of eight hours up to and including 12 hours in any workday, and for the first eight hours worked on the seventh consecutive day of work in a workweek
• Double the employee’s regular rate of pay for all hours worked in excess of 12 hours in any workday and for all hours worked in excess of eight on the seventh consecutive day of work in a workweek
